The State Duma introduces total control over cash transactions

At a plenary meeting on Tuesday, the State Duma approved in the third and final reading a bill to strengthen control over cash transactions. Currently, banks are required to report to Rosfinmonitoring if a legal entity withdraws or credits more than 600 thousand rubles from an account, and the transaction is not related to the economic activities of the business - for example, crediting revenue in cash or issuing salaries to employees.

The law abolishes this condition and makes control total: from now on, all cash transactions above a threshold amount, regardless of their nature, fall under it.

The list of information that banks are required to transfer to Rosfinmonitoring is also expanding if there is a suspicion that clients’ transactions are aimed at laundering proceeds from crime or financing terrorism. From March 1, 2022, banks will report not only on the transactions themselves, but also on other client actions that are associated with them, and will also disclose all available information about the beneficiaries of the transaction or transfer.

The same requirements apply to microfinance organizations, professional participants in securities markets, non-state pension funds, insurers, gambling organizers, investment platform operators, pawnshops and other organizations.

Postal transfers in the amount of 100 thousand rubles (or the equivalent in foreign currency) will come under control.

Mandatory control will apply to the crediting of funds to an account (deposit) or debiting funds from the account (deposit) of a foreign structure without the formation of a legal entity (now this rule applies only to legal entities), to the payment of insurance compensation to a legal entity or the receipt of an insurance premium from a legal entity.
